These Terms of Use govern access to and use of the LotHelm software (“the app”) by authorized dealership users and operators. The app is internal dealership operations software, not a public-facing consumer service.
This page is an early draft and is pending legal review. The wording below may change, and counsel must review it before anyone relies on it.
Authorized access only
Access is limited to users the dealership has authorized. You may use the app only with an account provisioned for you and only for the dealership's legitimate business purposes. Do not access, or attempt to access, the app or any data without authorization.
Account security
Keep your sign-in credentials confidential and do not share your account. You are responsible for activity that occurs under your account. Notify a dealership administrator promptly if you believe your account has been compromised.
Internal dealership use
The app is provided for the internal operations of the dealership that authorized your access. Do not use it for any outside, personal, or competing purpose, and do not use it on behalf of anyone other than that dealership.
Your responsibility for entered data
You are responsible for the accuracy and appropriateness of the information you enter. The app records and organizes what operators enter and generates dealership paperwork from that data; it does not independently verify it. Review generated documents and figures before relying on or delivering them.
No legal, tax, or accounting advice
The app and its content — including any generated forms, notices, summaries, or calculations — are operational tools, not legal, tax, or accounting advice. They are not a substitute for review by qualified professionals.
Not a replacement for required documents
Documents and figures produced by the app do not replace, satisfy, or limit any disclosure, notice, contract, or filing the dealership is required to provide to its customers or to any authority. The dealership remains responsible for meeting its own legal and regulatory obligations.
Confidentiality of dealership and customer data
The app contains confidential dealership and customer information. Use it only as needed for your authorized work, do not disclose it to anyone not entitled to it, and handle it consistent with the dealership's policies and applicable law.
Acceptable use
Do not misuse the app. In particular, do not attempt to disrupt or circumvent its security or access controls, scrape or extract data beyond your authorized use, interfere with other users, or use it to do anything unlawful.
Availability may change
The app is provided on an as-is, as-available basis. Features may change, and access may be suspended or discontinued at any time without notice. This draft does not promise any particular uptime or service level.
